This Privacy Policy (“Policy”) describes how Lemieux et Cie LLC (“Lemieux et Cie,” the “Company,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you visit lemieuxetcie.com (the “Site”), make a purchase, visit our retail locations, or otherwise interact with us. It also explains your rights under applicable privacy and data protection laws.

We reserve the right to periodically update this Privacy Policy and reserve the right to change the provisions of this Privacy Policy or our privacy practices at any time. We encourage you to review this Site periodically and we will alert you that changes have been made by updating the Effective Date of the Policy.updating the Last Updated date of the Policy.

Where required by law, your consent to the collection and use of personal information is obtained through cookie consent tools, opt-in forms, or similar mechanisms. If you choose not to provide certain personal information or withdraw consent, some features or services may be unavailable. Under California law (CCPA/CPRA), you have the right to opt out of the sale or sharing of your personal information and the use of sensitive personal information for certain purposes. We will not discriminate against you for exercising your privacy rights as prohibited by California Civil Code § 1798.125.

The Site is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to provide our services and sell our products to you. Your information and Personal Information are stored through Shopify’s data storage, databases, and the general Shopify application. They store your data on a secure server behind a firewall. Shopify’s Privacy Policy is here, and applies to all data they collect. It is encrypted according to the requirements of the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. 3. Children’s Privacy

Our Site is not directed to children under the age of 13 in the United States or under 16 in the European Union and United Kingdom. We do not knowingly collect personal information from children without legally required parental consent. If we become aware that personal information has been collected from a child without such consent, we will take reasonable steps to delete it promptly.

These widgets may collect your IP address, your web browser user information, store and retrieve cookies on your browser, embed additional tracking, and monitor your interaction with the widget, including correlating your applicable social media account with whatever action you take within the applicable widget (such as e.g. “liking/sharing/recommending” our webpage), if you are logged in to such applicable social media. We may also maintain log files that contain IP addresses. In general, we may use log files to monitor traffic on our Site, troubleshoot technical problems, and potentially report aggregate information to our advertisers. In the event of user abuse of our Site, however, we may block certain IP addresses or console IDs, as applicable. If available, IP addresses and console IDs may be used to personally identify you in order to enforce our Terms.

6. In-Store Data Collection and Video Surveillance

We use closed-circuit television (CCTV) and similar security monitoring systems in our retail locations for safety, security, loss prevention, and operational purposes.

Video footage:

  • Is retained for a limited period unless required for investigation or legal compliance

Sensitive Personal Information (California Residents)

We do not use or disclose sensitive personal information for purposes other than those permitted by the California Privacy Rights Act (CPRA). Sensitive personal information, such as payment credentials, is used solely to complete transactions, prevent fraud, and comply with legal obligations. California consumers have the right to limit the use and disclosure of their sensitive personal information to these permitted purposes by submitting a request as described in Section 17 of this Privacy Policy.


Anonymous Data


We may create aggregated, de-identified or other anonymous data records from your Personal Information and other individuals whose Personal Information we collect. We make Personal Information into anonymous data by excluding information (such as your name) that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes, including to analyze and improve the Site and promote our business.

Our service providers are contractually obligated to maintain appropriate security measures and use your personal information only as directed by us and consistent with this Privacy Policy. While we have no responsibility for or control over the independent products or services of these companies beyond our contractual arrangements, we remain responsible under California law for the personal information we share with them as service providers.

We do not sell personal information for monetary compensation. However, under California law (CCPA/CPRA), certain data sharing for advertising or analytics purposes may be considered a “sale” (as defined in Cal. Civ. Code § 1798.140(ad)) or "sharing" for cross-context behavioral advertising (as defined in Cal. Civ. Code § 1798.140(ah)). In the preceding 12 months, we have shared the following categories of personal information for targeted advertising purposes: identifiers (such as email addresses and device identifiers), internet or network activity information, and commercial information (such as purchase history). California residents have the right to opt out of such sales or sharing.

Sharing With Marketing and Data Partners

We may share certain customer information with marketing and data partners to support advertising and marketing. You can opt out at any time using our “Do Not Sell or Share My Personal Information” link or by submitting a request as described in Section 17 of this Privacy Policy. If you opt out, we will not share your information for these purposes going forward. We will process your opt-out request within 15 business days and maintain your information on a suppression list for at least 12 months to help ensure it is not included in future sharing, as required by Cal. Civ. Code § 1798.135.

The Site may contain advertising or links to web sites operated by third parties either on a free or fee-based basis. The fact that our Site contains links to third-party information and websites is not an endorsement or representation of our affiliation with that third party. By clicking on one of these links, you will leave the Site and will be subject to the terms and conditions and privacy policy of the linked website. Because we cannot control the activities of third parties, we cannot accept responsibility for any use of your Personal Information by such third parties, and we cannot guarantee that they will adhere to the same privacy and security practices as we do. If you visit a third-party website that is linked to our Site, you should consult that website’s terms and conditions of use and privacy policy and contact them if you have any questions about their respective policies and practices especially before providing any Personal Information or other information.

9. Behavioral Advertising and Analytics

We use personal information to deliver relevant advertising and analyze performance. This may involve cookies and similar technologies. 

We collect and store information about the pages viewed by all of our Site visitors. We may then use this data in aggregate form to identify overall Site visitor behavior patterns. Our goal in using this information is to improve our Site by making it more responsive to the needs and preferences of our users. Our servers automatically collect information about each visitor who requests our Site pages, including your computer's internet protocol (IP) address. This IP address allows us to identify your computer on the internet so that the Site content you request from us can be sent to you. Customer List–Based Advertising (“Matched Ads”)

We may share or upload limited customer information, such as email addresses, in hashed or encrypted form, with advertising platforms (such as Google or Meta) to create custom audiences, deliver relevant advertisements, or exclude existing customers from certain campaigns.


These platforms may compare our hashed information against their own user databases to determine whether there is a match. We do not share plaintext personal information for this purpose, and we do not receive information about individuals who are not matched.

10. Session Replay and User Experience Analytics

We use Microsoft Clarity, a user experience analytics tool, to understand how visitors interact with our Site. Clarity records information such as clicks, scrolling, navigation patterns, and interactions with page elements to help us improve site functionality, usability, and performance.

Clarity is configured to mask or exclude sensitive personal information, including payment details and passwords. Data collected through Clarity is used solely for analytics, troubleshooting, and site optimization purposes. Session replay technologies are activated only in accordance with applicable consent requirements and your cookie preferences.

11. Marketing Communications

If you subscribe to our newsletter or opt in during checkout, we may use your personal information to send you marketing emails or SMS messages about new products, exclusive offers, and other updates.

We use Klaviyo as our email and SMS marketing provider. Your contact details (such as name, email address, and phone number) may be shared with Klaviyo to help us manage communications, personalize content, and analyze engagement. For more information, you can review Klaviyo’s Privacy Policy.

SMS Messaging

If you opt in to receive SMS or text messages from us, we may send you promotional messages, transactional notifications, or service-related communications. By opting in, you expressly consent to receive recurring automated marketing text messages at the phone number you provide. Message frequency may vary. Consent to receive marketing messages is not a condition of any purchase.

You may opt out of SMS messages at any time by replying STOP to any message, and you will receive a confirmation message. After opting out, you will no longer receive SMS messages from us unless you opt in again. For assistance, reply HELP or contact us using the information in Section 1.

Message and data rates may apply. Wireless carriers are not liable for delayed or undelivered messages. We are not responsible for any delays or failures in message delivery by your wireless carrier. For support or questions about our SMS program, contact us using the information in Section 1. By participating in this SMS program, you agree to these terms and confirm that you are the account holder or have the account holder's permission to opt in.have the account holder's permission to opt in to the program.

Texas Residents - SMS Marketing: We comply with Texas law regarding text message marketing, including Texas Business and Commerce Code Chapter 305 (SB 140). We will not send you marketing text messages without your prior express written consent. You may revoke consent at any time by replying STOP to any marketing text message. Standard message and data rates may apply. We do not use cookies to collect telephone numbers for unsolicited text marketing.

13. User-Generated Content and Social Media Interactions

If you tag us on social media, use our branded hashtags, submit content, or otherwise share user-generated content (“UGC”) with us, we may collect and process information associated with that content, such as your name, username, profile image, captions, images, videos, and related metadata.

We use this information to feature, repost, and promote community content across our website, social media channels, marketing materials, and communications, in accordance with our User-Generated Content Policy. Processing is based on your consent or our legitimate interests, depending on your location and applicable law. You may request removal as described in that policy.

14. Legal Basis for Processing (GDPR Requirement)

If you are a resident of the European Economic Area (EEA), we process your personal information in accordance with the General Data Protection Regulation (GDPR), under the following lawful bases:

  • Your consent;

  • The performance of the contract between you and the Site;

  • Compliance with our legal obligations;

  • To protect your vital interests;

  • To perform a task carried out in the public interest;

  • For our legitimate interests, which do not override your fundamental rights and freedoms.

15. Retention

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, including to provide you with services, comply with our legal obligations, resolve disputes, and enforce our agreements. Specific retention periods vary by data type and purpose, and we maintain a data retention schedule that specifies these periods. For California residents, in accordance with CPRA requirements, we will not retain personal information for each disclosed purpose longer than reasonably necessary for that purpose. Upon request, we can provide information about the specific retention period applicable to your personal information or the criteria used to determine that period.

16. Automatic decision-making

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you. Services that include elements of automated decision-making include:

  • Temporary blacklist of IP addresses associated with repeated failed transactions (persists for a small number of hours)

  • Temporary blacklist of credit cards associated with blacklisted IP addresses (persists for a small number of days)


17. Your Rights

Your rights depend on your location and applicable privacy laws. Below is a summary of rights available under major privacy frameworks.

European Economic Area (GDPR)  

If you are a resident of the EEA, you have the right to:

  • Access the personal information we hold about you

  • Port your data to a new service

  • Request that your personal information be corrected, updated, or erased

  • Object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you


Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States. CCPA / CPRA (California)

The California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), grants certain rights to California residents. California defines a "resident" as (1) every individual who is in the State of California for other than a temporary or transitory purpose and (2) every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose. All other individuals are defined as "non-residents." If you are a California resident, under the CCPA and CPRA, you have the right to:

  • Know what personal information we collect, use, disclose, and share

  • Access, correct, delete, and obtain a portable copy of your personal information

  • Opt out of the sale or sharing of personal information, including for targeted advertising purposes

  • Designate an authorized agent to submit a request on your behalf, subject to verification requirements.


We may require the authorized agent to provide proof of authorization and may require you to verify your identity directly with us or confirm that you provided the agent permission to submit the request.


We do not sell personal information for monetary consideration. However, certain data sharing with analytics, advertising, or social media partners may be considered a "sale" or "sharing" under California law. This may include sharing personal information collected through cookies and similar tracking technologies with third-party advertising networks for targeted advertising purposes.

To exercise this right, please use our "Do Not Sell or Share My Personal Information" link or adjust your cookie preferences. We will process your opt-out request within 15 business days and will not require you to create an account to exercise this right.

Other U.S. State Privacy Laws (Virginia, Colorado, Connecticut, Utah, etc.)

Depending on your state of residence, you may have the right to:

  1. Confirm whether we process your personal data and access such data

  2. Obtain a portable copy of your personal information

  3. Correct or delete personal information

  4. Opt out of targeted advertising, the "sale" or "sharing" of personal information, and certain types of profiling

  5. Appeal our decision if we deny your request


Canada (PIPEDA)


If you are a resident of Canada, your personal information is handled in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA). You have the right to:

  • Access the personal information we hold about you

  • Request corrections

  • Withdraw consent at any time (subject to legal or contractual restrictions)


How to Exercise Your Rights


You have the right to request that we delete Personal Information collected by us. Upon receipt of such request, we will delete your Personal Information collected as of the date of such request, except when necessary to: (i) complete the transaction for which the Personal Information was provided or perform a contract with you; (ii) detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity and prosecute those responsible; (iii) debug to identify and repair errors that impair existing intended functionality; (iv) exercise free speech (of business or another consumer) or other rights; (v) comply with the California Electronic Communications Privacy Act; (vi) engage in public or peer reviewed research in the public interest; (vii) enable internal uses reasonably aligned with the expectations of the consumer based on their relationship with the business; and (viii) comply with a legal obligation; (ix) use your Personal Information(viii) comply with a legal obligation; and (ix) use your Personal Information, internally, in a lawful manner that is compatible with the context in which the consumer provided the information.


To submit a request to delete your personal information, you must provide sufficient information to allow us to verify your identity, including at minimum your full name and email address. We will use this information solely for the purpose of verifying your identity and processing your deletion request. We will respond to your verified request within 45 calendar days of receipt, unless we need an additional 45 calendar days to respond, in which case we will notify you of the extension within the first 45-day period and provide an explanation for the delay. Notwithstanding the above, we will respond within a different period of time if your jurisdiction requires the same. You may call or e-mail us with your request at the contact information provided in Section 1 of this Privacy Policy. 


If your deletion request is subject to any exception under applicable law, we will inform you of the specific exception and the legal basis for it. We will delete your personal information that is not subject to an exception. Once your request to delete is processed and verified, we will delete your personal information from our records and will direct our service providers, contractors, and third parties to whom we have disclosed your personal information to delete such information from their records, except where retention is necessary or permitted under applicable law. For California residents, we will notify third parties to whom we have sold or shared your personal information to delete such information unless this proves impossible or involves disproportionate effort.


Please note that if we delete your Personal Information, you may not be able to use certain Site functions that require your Personal Information, and services that require your Personal Information may be disrupted.


To exercise any of your other rights as provided in this Privacy Policy, contact us using the information provided in Section 1. We will process requests in accordance with applicable law.


18. Financial Incentives and Promotional Programs

We may offer certain programs or promotions that provide benefits in exchange for personal information, such as our Trade Program or one-time discounts for signing up to receive marketing communications. Participation in these programs is voluntary.

The personal information collected in connection with these programs is used solely to administer the program or promotion and communicate with participants. You may withdraw from a program or opt out of marketing communications at any time, subject to applicable terms.

Any difference in price or benefits is reasonably related to the value of providing such services and administering the program, and we do not sell personal information in connection with these programs.

19. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use. These measures include, where appropriate, encryption in transit or at rest (for example, HTTPS/TLS), limiting access to personal information to personnel and service providers with a legitimate business need, and periodic review of our security practices. 

However, no method of transmission over the Internet or method of electronic storage is perfect, and we cannot guarantee absolute security.

20. International Data Transfers

If you are located outside the United States, please note that your personal data may be processed in the United States and other countries where our service providers operate. These countries may not have the same data protection laws as your country of residence.

Where required by applicable law, we rely on appropriate safeguards for cross-border data transfers, such as Standard Contractual Clauses approved by the European Commission or equivalent mechanisms.
