Text Messaging Terms & Conditions

Company: Lemieux et Cie LLC ("Lemieux et Cie," "we," "us," "our")

These Text Messaging Terms & Conditions ("Terms") govern your participation in Lemieux et Cie text message programs. By enrolling in any program described below, you agree to these Terms.

1. Programs Covered by These Terms

We offer two separate text programs:

A. Order & Delivery Text Alerts (Transactional)

Messages related to purchases, fulfillment, and delivery/service.

B. Marketing Text Messages (Promotional)

Messages about promotions, new collections, events, and other marketing content.

You can enroll in one program without enrolling in the other.

2. Eligibility and Enrollment

You must provide a valid mobile number and complete the applicable opt-in process (e.g., checkbox consent, account setting, or keyword sign-up). You represent that you are the subscriber or customary user of the number you enroll (or have authorization to enroll it).

Consent is not a condition of purchase. You can purchase from us without agreeing to receive texts.

3. Consent to Receive Texts; Automated Technology

By opting in to a program, you authorize Lemieux et Cie and our service providers to send you SMS and/or MMS messages at the mobile number you provided using automated and/or non-automated technology.

4. Message Frequency and Costs

Message frequency varies based on your activity and the program you enroll in.

We do not charge for texts, but message and data rates may apply. You are responsible for charges imposed by your wireless provider. Wireless carriers are not liable for delayed or undelivered messages.

5. Privacy and Device Security

Texts may include limited information about your orders, deliveries, or offers (depending on the program). Anyone with access to your phone or carrier account may be able to see these messages.

Information collected in connection with these programs is handled under our Privacy Policy.

Program A: Order & Delivery Text Alerts (Transactional)

6. What You’ll Receive (Examples)

If you enroll in Order & Delivery Text Alerts, you may receive messages such as:

  • Order confirmation and status updates

  • Delivery scheduling, reminders, and updates

  • Delay/reschedule notices, service exceptions, and support prompts

  • Post-delivery satisfaction surveys

7. Opt-Out and Help (Transactional)

Stop Transactional texts: Reply STOP to the number/short code from which you received the transactional message. You may receive one final confirmation message.

Program B: Marketing Text Messages (Promotional)

8. What You’ll Receive (Examples)

If you enroll in Marketing Text Messages, you may receive messages such as:

  • Promotions, discounts, and limited-time offers

  • Product drops, new collections, curated picks

  • Back-in-stock alerts (if offered)

  • Invitations to events or announcements

9. Opt-Out and Help (Marketing)

Stop Marketing texts: Reply STOP to the number/short code from which you received marketing messages. You may receive one final confirmation message.

10. Managing Opt-Outs Across Both Programs

Your opt-out applies as follows unless we clearly indicate otherwise at enrollment:

  • If transactional and marketing texts use separate numbers/short codes, replying STOP to one will stop texts from that program only.

  • If both programs use the same number/short code, replying STOP may stop all Lemieux et Cie texts to that number (transactional and marketing).

  • If you want to keep transactional updates but stop marketing, use the STOP command on the marketing message thread/short code (if separate).

11. Supported Carriers; Availability

Text programs may not be available in all regions or through all carriers, and may not work on all devices. Delivery may be affected by carrier issues, device settings, coverage limitations, or outages.

12. Changes, Suspension, or Discontinuation

We may modify, suspend, or discontinue either text program at any time. We may update these Terms from time to time. If we make material changes, we will post the updated Terms on our website and revise the Effective Date above. Your continued enrollment after the Effective Date means you accept the updated Terms.

13. Disclaimers and Limitation of Liability

Text programs are provided "as is" and may be delayed, interrupted, or unavailable.

To the maximum extent permitted by law, Lemieux et Cie will not be liable for indirect, incidental, special, consequential, or punitive damages related to the text programs (including delays or delivery failures). Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Dispute Resolution (Informal Resolution; Small Claims; Arbitration)

Informal resolution first. Before initiating arbitration, you and Lemieux et Cie agree to attempt to resolve disputes informally. Send a notice describing the issue and requested relief to assist@lemieuxetcie.com. If the dispute is not resolved within 30 days, either party may proceed as described below.

Small claims option. Either party may bring eligible claims in small claims court.

Arbitration. Except for small claims matters, disputes arising out of or relating to these Terms or the text programs will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in New York, New York.

Format and location. Arbitration will generally be conducted by phone, video, or written submissions unless an in-person hearing is required. If in-person, the hearing location will be reasonably convenient to both parties.

Fees. Lemieux et Cie will pay arbitration fees as required by AAA consumer rules or applicable law. Each party pays its own attorneys’ fees unless a law provides otherwise.

No class actions. Arbitration will be conducted only on an individual basis. The arbitrator may not consolidate claims or preside over any class, collective, or representative proceeding.

Optional opt-out (recommended). You may opt out of the arbitration provision within 30 days of first enrolling in a text program by sending written notice to assist@lemieuxetcie.com, including your name, mobile number, and a statement that you are opting out of arbitration for Lemieux et Cie text programs.

15. Governing Law; Severability

These Terms are governed by the laws of the State of New York, except where federal law applies.

If any provision is found unenforceable, the remaining provisions remain in effect. If the class-action waiver is found unenforceable, the arbitration requirement will be severed and disputes will be resolved in court to the extent permitted by law.
